Dept/Agency: Offices of Municipal Council and City Clerk Action: ( ) Ratifying (X) Authorizing ( ) Amending Type of Service: Executive Session Purpose: Excluding the public from portion of meeting to discuss pending litigation, Sara and Victor Lesende, Docket. # 06-4957, item 7R7-a (s) 120914, and matters falling within the attorney client privilege as it pertains to the rescinding resolution for Greater Newark Conservancy, Inc. and an action taken by the Board of Adjustment Meeting: Special Meeting Date: December 9, 2014 Time: Commencing at 10:20 a.m. and ending at 11:08 a.m. WHEREAS, on December 9, 2014, a Special Meeting of the Municipal Council was convened in accordance with the provisions of N.J.S.A. 10:4-6 et seq.; and WHEREAS, during said Special Meeting the Newark Municipal Council desired to discuss under closed session pending litigation and matters falling within the attorney-client privilege and WHEREAS, N.J.S.A. 10:4-12(b)(7) authorizes the exclusion of the public from discussions concerning said matters; and WHEREAS, the Newark Municipal Council by this Resolution adopted at said Special Meeting on December 9, 2014 commencing at 10:20 a.m. and ending at 11:08 a.m. voted to exclude the public from said discussion. NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY: 1. That the part of the Special Meeting of the Newark Municipal Council containing the discussion on such pending litigation and matters falling within the attorney-client privilege is closed to the members of the public under the provisions of N.J.S.A. 10:4-12(b)(7) and 2. That the minutes of these discussion items conducted in the closed session of the Special Meeting held on December 9, 2014, commencing at 10:20 a.m. and ending at 11:08 a.m., shall be disclosed to the public upon application to the City Clerk after the need for confidentially in connection with this matter no longer exists. STATEMENT This resolution authorizes an executive session during a Special Meeting held on December 9, 2014.
